Child Support Guidelines

Determining recommended child support has been reduced to a formula by the Maryland legislature.

     The Child Support Worksheet, below, requires the collection of financial data from both parents.   The amount of child support is determined by the joint income of the parents and the number of children to be supported.  The Child Support Schedule (which follows the worksheet on this same page) provides the actual dollar amount of monthly support.

     The Worksheet assumes one parent has sole physical custody of the children, and that the other, non-custodial parent will pay the monthly child support figure to the custodial parent.  The monthly term is used for convenience; child support may be made payable at other regularly-scheduled intervals.

Child Support Schedule

The following table is an abbreviated version of the Maryland Child Support Schedule.  The full version of the Schedule adjusts child support based upon the Combined Actual Adjusted Income column in $50 increments.

Definitions to Determine Line 4 Expenses

Work-related child care expenses.-
     (1) Subject to paragraphs (2) and (3) of this subsection, actual child care expenses incurred on behalf of a child due to employment or job search of either parent shall be added to the basic obligation and shall be divided between the parents in proportion to their adjusted actual incomes.
     (2) Child care expenses shall be:
          (i) determined by actual family experience, unless the court determines that the actual family experience is not in the best interest of the child; or
          (ii) if there is no actual family experience or if the court determines that actual family experience is not in the best interest of the child:
               1. the level required to provide quality care from a licensed source; or
               2. if the custodial parent chooses quality child care with an actual cost of an amount less than the level required to provide quality care from a licensed source, the actual cost of the child care expense.
     (3) Additional child care expenses may be considered if a child has special needs.

Extraordinary medical expenses.-
     Any extraordinary medical expenses incurred on behalf of a child shall be added to the basic child support obligation and shall be divided between the parents in proportion to their adjusted actual incomes.

Additional Expenses: School and transportation expenses.-
     By agreement of the parties or by order of the court, the following expenses incurred on behalf of a child may be divided between the parents in proportion to their adjusted actual incomes:
          (1) any expenses for attending a special or private elementary or secondary school to meet the particular educational needs of the child; or
          (2) any expenses for transportation of the child between the homes of the parents.
